Focal — Terms of Use

Focal is operated by Fleckslabs Technology Private Limited, a company incorporated under the Companies Act, 2013, with its registered office in Hyderabad, Telangana, India ("Fleckslabs", "we", "us"). These Terms govern your use of the Focal mobile application and related services (the "App"). By using the App you agree to them. If you do not agree, do not use the App.

1. Your account

An account is created against a verified mobile number. You are responsible for keeping access to that number secure; anyone who can receive its verification code can reach your account, including your credit balance and your photos. Tell us at contact@fleckslabs.com if you lose control of the number.

You must be 13 or older. If you are under 18, you may use Focal only with the consent of a parent or guardian, who accepts these Terms on your behalf.

2. What Focal does

Focal uses artificial intelligence to restyle, enhance and restore photographs you provide. Results are generated by a model and are inherently variable: they will not always match the original, will not always match your expectation, and the same input can produce different outputs. Focal is for personal and creative use. It is not suitable for identification, medical, forensic, evidentiary or legal purposes.

3. Photos you upload

• You keep ownership of the photos you upload and of the results you generate.
• You grant us a limited licence to process, store and transmit your photos solely to provide the service to you — to run the generation, deliver the result, and support you if something fails.
• We do not sell your photos, do not show them to other users, and do not use them for advertising.
• Uploads are deleted on a schedule (currently uploads after 7 days, results after 30 days). You can delete everything sooner from Settings.
• You must have the right to upload each photo. Do not upload photographs of other people without their permission, and do not upload images of children other than those in your care.

4. Acceptable use

You agree not to use Focal to:

• create sexual content, or any content involving a minor in a sexual context;
• impersonate a real person, or create images intended to deceive others about who someone is or what they did;
• harass, defame or endanger anyone;
• generate content that is unlawful in India or where you are;
• circumvent credit limits, resell access, or automate the service outside the App.

We may suspend or close an account that breaches this section. Where we do, we will say why unless we are legally prevented from doing so.

5. Credits

Generation consumes credits. One credit produces one photo. Credits are a licence to use the service, not currency: they have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.

If a generation fails for a reason on our side, the credit is returned automatically. A result you simply do not like is not a failure and is not refunded — the output of a generative model varies, which is why the App shows what a style looks like before you spend anything.

6. Subscriptions and payment

Focal Pro is an auto-renewable subscription. Prices, credit allowances and any introductory offer are shown in the App before you pay; the figures displayed at the moment of purchase are the ones that apply to you.

If you subscribe through the App Store or Google Play:

• Payment is charged to your Apple Account or Google Account on confirmation of purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the end of that period.
• Manage or cancel in your store account settings. Deleting the App does not cancel a subscription.
• Refunds are handled by the store that billed you, under its policy. We cannot refund a payment we did not take.

If you subscribe inside the App using UPI:

• Payment is by UPI Autopay mandate, processed by Razorpay.
• Cancel from Settings → Manage subscription, or by emailing us. Cancelling stops future payments; you keep access until the period you have paid for ends.
• For these payments we are the merchant of record, and refund requests come to us.

Unused credits from a billing period do not carry over unless the App says otherwise at the time of purchase.

7. Availability and changes

We may change, suspend or withdraw features, styles and prices. Where a change materially reduces what a paid subscription provides, we will give notice in the App before it takes effect, and you may cancel. The style catalogue changes regularly and a particular style may be withdrawn.

8. Privacy

Our Privacy Policy explains what we collect, why, how long we keep it and how to exercise your rights under the Digital Personal Data Protection Act, 2023. It forms part of these Terms.

9. Liability

The App is provided "as is". To the extent permitted by law, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, or loss of data beyond what we hold for you.

Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you in any twelve-month period is limited to the greater of the amount you paid us in that period and INR 1,000.

10. Ending these Terms

You may stop using Focal at any time and delete your data from Settings. We may end your access if you materially breach these Terms. Sections 3, 5, 9 and 11 survive.

11. Governing law

These Terms are governed by the laws of India. The courts at Hyderabad, Telangana have exclusive jurisdiction, save that either party may seek injunctive relief in any competent court.
